Operator: Advanced Bot Alerts LLC (“ABA,” “we,” “us,” “our”)

Service: Discord-based stock alert and market information service in the AdvancedBotAlerts Discord server, including free/teaser channels and paid subscriber channels, bots, tools, and related digital content (the “Service”).
Direct Pay: Paid access sold through ABA’s own Stripe Checkout and managed through the Stripe Customer Portal (together, “Direct Pay”), with Discord roles granted or revoked by ABA’s Direct billing systems.
IMPORTANT: By clicking subscribe, completing payment (including free trial, weekly, monthly, six-month, yearly, or any other plan), redeeming access, viewing paid channels, or otherwise using the Service, you (“you,” “Subscriber,” “Payer”) agree to these Terms. If you do not agree, do not subscribe and do not access paid channels.
1. Parties & payment processor
1.1 Seller / Service provider: Advanced Bot Alerts LLC.
1.2 Payments for Direct Pay are processed by Stripe, Inc. and its affiliates (“Stripe”) on ABA’s behalf. Your payment method agreement is also governed by Stripe’s terms and policies.
1.3 These ABA Terms govern your access to our Discord Service. Stripe’s terms govern payment processing. Both apply. If there is a conflict about our alerts, content, or Discord access, these ABA Terms control; if about payment processing, Stripe’s terms control.
2. Description of the Service (digital goods)
2.1 The Service is a digital information and community product, including without limitation:
• Real-time and/or delayed Discord stock alerts and related messages
• Access to subscriber-only Discord channels and roles
• Optional tools/commands (e.g. scanners, lookups, watchlists, bots)
• Educational / community discussion
2.2 No physical goods are shipped. Access is delivered electronically in Discord upon successful payment or trial grant of the applicable role(s).
2.3 Not investment advice. The Service is for informational and educational purposes only. Nothing we provide is a recommendation to buy, sell, or hold any security. You are solely responsible for your trading decisions. Past performance of any ticker, alert, or member is not indicative of future results. Trading stocks involves substantial risk of loss.
3. Eligibility
3.1 You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter this agreement.
3.2 You will not use the Service for any illegal purpose.
3.3 You will not share, resell, screen-record for resale, or redistribute paid alerts or paid channel content outside the Service without our written permission.
4. Subscriptions, billing & free trials
4.1 Plans may include free trial, weekly, monthly, six-month, yearly, or other options shown at Direct Pay checkout (“Subscription Choice”).
4.2 By completing checkout you authorize recurring charges of the Subscription Choice amount on each Billing Cycle until you cancel.
4.3 First payment (or trial start) is due at signup. Subsequent payments are due each Billing Cycle thereafter until cancellation.
4.4 Prices may exclude taxes, processor fees, or currency conversion charges that may apply.
4.5 We may change pricing or plans prospectively; changes apply to future billing periods after notice (including notice via Discord, email, or the Direct Pay site).
5. Delivery of Service (critical for payment disputes)
5.1 Delivery is complete when, after successful payment or trial activation, you receive one or more of:
• A paid Discord role (e.g. Direct Premium, Direct Family, Direct Trial, or equivalent)
• Access to one or more paid/subscriber channels
• Ability to receive live or paid alerts via the Service bots
5.2 Delivery is immediate or near-immediate upon role grant. Failure to open Discord, mute channels, leave the server, or ignore messages does not mean non-delivery.
5.3 You agree that Discord message history, role assignment logs, bot logs, server audit logs, and Stripe / Direct Pay records may be used as proof of delivery and use of the Service.
6. Acceptance of these Terms (consent)
6.1 You accept these Terms by any of:
• Completing payment / free trial signup through ABA Direct Pay (Stripe Checkout) or a linked Direct Pay flow
• Clicking agree/subscribe on any checkout or bot panel that links to these Terms
• Accessing paid channels after purchase
6.2 You agree we may retain records of your Discord user ID, username, join date, role history, Stripe customer and subscription identifiers, and related technical logs for fraud prevention, accounting, and dispute resolution.
7. Cancellation
7.1 You may cancel recurring billing through the Stripe Customer Portal linked from the Direct Pay site (or other Stripe management tools we provide) before the next Billing Cycle.
7.2 Cancellation stops future charges. It does not automatically entitle you to a refund for the current period already paid.
7.3 After cancellation or non-payment, we may remove paid roles and channel access immediately or at period end at our discretion.
8. NO REFUNDS (digital delivery)
8.1 ALL SALES ARE FINAL. Because the Service is digital and delivered immediately (role/channel access and/or alerts), we do not provide refunds for:
• Change of mind
• Unused access
• Partial billing periods
• Early cancellation
• Dissatisfaction with market outcomes or trading results
• Failure to read alerts or use channels
• Account/Discord issues on your side (muted channels, wrong server, banned for rules violations after fair notice, etc.)
8.2 Free trials: If a free trial is offered, cancel before trial end to avoid conversion to paid. Failure to cancel is not grounds for a refund of the first paid period after trial.
8.3 Limited exception: If we fail to deliver any paid access for a sustained period due solely to our fault (e.g. server permanently offline with no alternative), contact us within 7 days and we may, at our sole discretion, provide a pro-rata credit, free extension, or refund. Chargebacks are not the first remedy.
8.4 Opening a chargeback/dispute with your bank or card issuer while retaining or after using access is a material breach. We may permanently ban you and submit full evidence to the processor.
9. Chargebacks, disputes & evidence
9.1 Before filing any payment dispute, you agree to contact us first via Discord (owner/admin or designated support channel) and allow at least 5 business days for a response.
9.2 You acknowledge that filing a dispute for “services not received” or “not as described” after receiving Discord role/channel access or alerts is false if access was granted.
9.3 You authorize us to provide to Stripe and card networks:
• Your Discord ID, username, join date, role history
• Evidence of channel access and message/alert delivery
• These Terms and our no-refund policy
• Checkout / subscription records from Stripe and Direct Pay
• Any communications
9.4 Friendly fraud / abuse: Repeated or fraudulent disputes may result in permanent ban and collection of amounts owed plus fees where permitted by law.
10. Non-payment & suspension
10.1 If payment fails or is reversed, we may immediately discontinue paid Service (remove roles, revoke channels, stop alerts).
10.2 You remain responsible for amounts already due for delivered access.
11. Risk disclosure & limitation of liability
11.1 You alone are responsible for all trading profits and losses.
11.2 To the maximum extent permitted by law, ABA, its members, officers, employees, agents, bots, and other Discord members are not liable for any trading losses, lost profits, data loss, or consequential damages arising from use of the Service or reliance on any alert, tool, or message.
11.3 Our total liability for any claim relating to a paid subscription is limited to the amount you paid us for the single Billing Cycle in which the claim arose.
11.4 The Service is provided “AS IS” and “AS AVAILABLE” without warranties of uninterrupted uptime, accuracy of market data, or fitness for a particular trading strategy.
12. Conduct & termination for cause
12.1 We may suspend or ban you (and cancel access without refund) for: spam, scams, abuse, sharing paid content, chargeback fraud, harassment, or violation of server rules or these Terms.
12.2 Server rules posted in Discord are incorporated by reference.
13. Intellectual property
13.1 Alerts, bot outputs, watchlists, graphics, and channel content are owned by ABA or its licensors. Personal use within Discord only. No redistribution.
14. Privacy
14.1 We process Discord identifiers, Direct Pay account linkage, and usage data as needed to run the Service and fight fraud/disputes. Payment card data is handled by Stripe — not stored by ABA on Discord.
15. Changes to Terms
15.1 We may update these Terms by posting a new version at https://srv178994.hstgr.cloud/terms and/or in Discord. Continued paid use after the effective date constitutes acceptance. Material changes apply prospectively.
16. Governing law & venue (Texas / Fort Bend County)
16.1 These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules.
16.2 Informal resolution first via Discord. Subject to applicable law, exclusive venue for any court action arising out of these Terms shall be the state or federal courts located in Fort Bend County, Texas, and you consent to personal jurisdiction there, except where prohibited.
17. Severability & entire agreement
17.1 If any provision is unenforceable, the rest remains in effect.
17.2 These Terms plus server rules and your Direct Pay checkout plan details are the entire agreement regarding the Service, superseding prior oral statements.
18. Contact
For billing or access issues: contact server owner/admin in the AdvancedBotAlerts Discord (https://discord.gg/cyh9JwNcbt) before opening a bank dispute.
Payment processing questions: Stripe (https://stripe.com) and Stripe’s published terms and policies.
19. Short acknowledgment (checkout / bot panel)
By subscribing, starting a free trial, or accessing paid channels, you confirm that you have read and agree to:
1. The Service is digital and delivered via Discord roles/channels/alerts.
2. No refunds after delivery of access.
3. Not financial advice; you accept full trading risk.
4. You will contact us before any chargeback; we may submit full access logs to win disputes.
5. Stripe’s processor terms also apply to payment for Direct Pay.
Effective upon first payment or trial activation through Direct Pay.
